UN CERD Urges India to Address Caste, Race Discrimination Concerns

India has drawn "grave concern" from the United Nations Committee on the Elimination of Racial Discrimination (CERD) over reports of violence and discrimination targeting minority ethnic and religious groups, Dalits, and non-citizens. In its first review since 2007, the UN body also criticized India’s failure to provide updated information on state inquiries and sanctions related to such allegations. India ratified the International Convention on the Elimination of All Forms of Racial Discrimination in 1968.

The CERD review highlights multiple areas of concern. India has not updated the UN on caste-based discrimination despite caste bias being prohibited under the convention, as CERD considers discrimination based on inherited status—including caste—within its mandate. The Committee also flagged ongoing issues such as manual sewer cleaning despite a legal ban, hate speech against religious minorities, poor living conditions and mass refoulement of Rohingya Muslims, and large-scale deletions from the National Register of Citizens. The government’s use of laws like the Foreign Contribution Regulation Act (FCRA), Unlawful Activities Prevention Act (UAPA), Armed Forces Special Powers Act (AFSPA), and Prevention of Money Laundering Act (PMLA) has been noted as restricting civil society organizations. The Bharatiya Nyaya Sanhita has also been criticized for not explicitly criminalizing racist hate speech. Additionally, the Forest (Conservation) Amendment Act’s exemption of "national security" projects from public consultation was highlighted as problematic.

The lack of disaggregated data on vulnerable communities further compounds these issues. Delays in conducting the Census and releasing National Crime Records Bureau (NCRB) data have hindered independent verification of India’s progress in combating caste- and faith-based discrimination. The National Human Rights Commission (NHRC) has also faced scrutiny, with the Global Alliance of National Human Rights Institutions recommending its downgrade in 2023 due to issues such as police officers being appointed to investigative roles and a lack of pluralism. The CERD report suggests that, given these gaps, the committee is stepping into a monitoring role that should ideally belong to domestic institutions.

Recommendations from the CERD include restoring the NHRC’s independence, explicitly criminalizing hate speech, strengthening affirmative action, publishing disaggregated data, improving transparency in electoral roll revisions, and enhancing enforcement of anti-discrimination laws. However, the Indian government has dismissed the CERD’s concerns as politically motivated and argued that issues affecting Dalits should remain a domestic matter, avoiding international scrutiny.

Civil society groups are expected to continue advocating for accountability in multilateral forums and challenging discriminatory policies through legal, political, and administrative means. The government’s response so far indicates that domestic institutions may not be fully equipped to address these systemic issues, leaving the burden of reform largely on external oversight and civil society pressure.
